On March 31, 2011. The new date of our Eviction, Paula Millard took her own life.


Some of us held on and took the landlord (Marineland of Canada) to the Landlord and Tenant Board. After several hearings and much evidence they still sided with Marineland of Canada. We will be updating the website with more information in the coming days.

If "John Holer" owner of Marineland and our Property can have such little compassion for 47 families consisting of Seniors, Elders, Disabled and Families with children, (fellow "human beings"). What kind of compassion does he have towards his animals????????????

IF YOU OR ANYONE YOU KNOW ARE LIVING IN A MOBILE HOME, MODULAR HOME OR IN A LANDLEASE COMMUNITY.
WE ARE SEEKING TO CHANGE THE WAY THE GOVERNMENT AND THE "LANDLORD AND TENANT ACT" TREATS LANDLEASE HOMEOWNERS.

WE REALIZE THAT IT IS WITHIN A PROPERTY OWNERS RIGHT TO SELL OR DEMOLISH THEIR PROPERTY,
HOWEVER IF THEY HAVE REAPED THE BENEFITS OF COLLECTING RENTS
WITH TENANTS PAYING FOR THEIR PROPERTY

  • IT SHOULD BE MANDATORY THAT THEY HAVE ALL PERMITS AND ZONING IN PLACE PRIOR TO EVICTION.
  • THEY SHOULD ALSO BE REQUIRED TO COMPENSATE EITHER "FAIR MARKET VALUE" OR "ASSESSMENT VALUE" TO HOME OWNERS WHO HAVE PAID THEIR RENTS FAITHFULLY TO HELP PROPERTY OWNERS PAY FOR THEIR LAND.

On Feb 23, 2009 forty-seven (47) families, the tenants of Green Oaks Mobile Home Park were given notice from the owner of the park "Marineland of Canada Inc." that they are terminating our lease and have given us 18 months (August 2010) to move our mobile homes. If we do spend the time and money to move it, we are entitled to $3000 according to the "Landlord and Tenant Act." These homes as you will see throughout this web site are not meant to be moved.

Our own City of Niagara Falls web site describes a Mobile Home as a "Permanent Residence"

Green Oaks Mobile Home Park is located at 8223 Stanley Ave in Niagara Falls, Ontario. It has been in existence since the early "60's".

In Dec of 2003, "Marineland of Canada Inc." purchased Green Oaks Mobile Home Park. They have now, 5 years later decided to "Close" the park terminating our lease aggreement.

We, the tenants of Green Oaks consist of seniors, children, people on disability, and hard working citizens that will no longer have a home to live in. Although these are considered "Mobile Homes", we will attempt to show you throughout this website how and why these homes can not be re-located.

We will attempt to show you why "Marineland of Canada Inc." decision to "Close this Park" and "End our Lease Aggreement" will cause us to lose everything we have invested in our homes.

We feel like because of the "Residential Tenancy Act" law in regards to "Landlease Communities" we as "Landlease Homeowners" have "NO RIGHTS".

Throughout this website we hope to educate the public as to what exactly a "Landlease Community" is. We are hoping that our "Government of Canada", "Government of Ontario" and our own "City of Niagara Falls" will someday recognize the following quote from the "Active Manufactured Home Owners Association" and then realize that these people need to be protected with their investments.

THE PRIMARY ISSUE THAT MUST BE DEALT WITH TO STABILIZE THIS TYPE OF AFFORDABLE HOUSING IS THE LEGAL DEFINITION OF: MANUFACTURED HOME PARKS

Are they:

  1. A Land Speculation Scheme which preys on homeowner/tenants and regards them as merely a financial resource to pay all expenses related to the land and pseudo business until the land appreciates enough to sell.


  2. OR

  3. A legitimate Business of "RENTING LAND FOR HOUSING" wherein homeowner/tenants are treated as equals with the same rights and protections as other home owners.

With parks closing and home owners in danger of losing their homes and their investments in them, this is a question that must be answered and dealt with by the federal, provincial and local governments as it has been neglected for decades by all levels of government.

As an Association working on behalf of manufactured home owners, we have been putting these questions to both levels of government but so far only some of the local governments have taken the limited amount of action that they can to protect this type of affordable housing.

Recognition and thanks must be given to all local governments who have taken steps trying to protect these vulnerable property tax paying home owners who have, in good faith, invested in this type of affordable housing.
